1. AGREEMENT TO TERMS

These Terms of Use (“Terms”) constitute a legally binding agreement between you (“you,” “User”) and MYDRY 30 LLC, doing business as Unconscious Moderation and MyDryJourney (collectively, “Company,” “we,” “us,” or “our”).

These Terms govern your access to and use of:

  • https://um.app
  • The Unconscious Moderation mobile application
  • The MyDryJourney mobile application (including Google Play distribution)
  • Any related websites, applications, SMS programs, coaching services, digital tools, and features
  • Any products or subscription services offered by us (collectively, the “Services”).

BY ACCESSING OR USING THE SERVICES, YOU:

  • Confirm you have read and understood these Terms
  • Agree to be legally bound by them
  • Represent that you are at least 21 years of age

If you do not agree, do not use the Services.

2. IMPORTANT HEALTH DISCLAIMER

The Services are educational and behavioral wellness tools.

WE ARE NOT A MEDICAL PROVIDER.

The Services do not:

  • Provide medical advice
  • Diagnose conditions
  • Treat disease
  • Provide detox services
  • Replace licensed healthcare

Always consult a physician before making changes to alcohol consumption.

If you believe you are experiencing a medical emergency, call 911 immediately.

Use of the Services does not create a doctor-patient relationship.

3. ELIGIBILITY

You must:

  • Be 21 years of age or older
  • Have legal capacity to enter a contract
  • Not be seeking medical treatment for Alcohol Use Disorder (AUD)

The Services are not appropriate for individuals who require medical detoxification or clinical addiction treatment.

4. ACCOUNTS

To access certain features, you must create an account.

You agree to:

  • Provide accurate information
  • Maintain account security
  • Keep login credentials confidential
  • Notify us of unauthorized access

You are responsible for all activity under your account.

We may suspend or terminate accounts at our discretion.

5. SUBSCRIPTIONS & BILLING

A. Subscription Model

Some Services are offered on a recurring subscription basis (monthly, quarterly, annual, etc.).

By subscribing, you authorize us (or our payment processor) to charge your selected payment method automatically until you cancel.

B. Free Trials

If you enroll in a free trial, you authorize us to charge your payment method when the trial ends unless canceled before expiration.

C. Cancellation

You may cancel:

  • Through your Apple App Store subscription settings
  • Through Google Play subscription settings
  • Through your account dashboard
  • By emailing support@um.app

Cancellation stops future renewals.
Fees already paid are non-refundable unless required by law.

6. SMS COMMUNICATIONS

By providing your phone number, you consent to receive:

  • Account alerts
  • Program reminders
  • Motivational messages
  • Marketing messages (if opted in)

Message frequency varies.
Message and data rates may apply.

You may opt out anytime by replying STOP.
For help, reply HELP or email support@um.app.

Consent to marketing texts is not required to purchase Services.

Mobile opt-in data and consent will not be shared with third parties for their marketing purposes.

7. USER CONTENT

You may submit journal entries, reflections, feedback, or other content (“User Content”).

You retain ownership of your User Content.

You grant us a non-exclusive, royalty-free, worldwide license to use, display, analyze, and reproduce such content solely to operate and improve the Services.

You represent that your content:

  • Does not violate laws
  • Does not infringe third-party rights
  • Is not harmful or unlawful

We may remove content at our discretion.

8. COACHING SERVICES DISCLAIMER

We may offer access to coaches.

Coaches are not:

  • Doctors
  • Therapists
  • Licensed medical providers

Coaching is educational and motivational only.

It is not:

  • Medical care
  • Psychological counseling
  • Therapy

You are solely responsible for your decisions and actions.

9. PROHIBITED USE

You agree not to:

  • Reverse engineer the Services
  • Copy or resell the Services
  • Scrape data
  • Use bots or automation
  • Interfere with platform security
  • Use the Services unlawfully

Violation may result in termination.

10. THIRD-PARTY SERVICES

The Services may integrate third-party services (payment processors, analytics providers, app stores).

We are not responsible for third-party policies or actions.

Your use of third-party services is governed by their terms.

11. INTELLECTUAL PROPERTY

All content, trademarks, logos, design, software, and materials are owned by MYDRY 30 LLC or its licensors.

You are granted a limited, personal, non-commercial license.

All rights not expressly granted are reserved.

12. DISCLAIMERS

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

WE DISCLAIM ALL WARRANTIES, INCLUDING:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • ACCURACY
  • NON-INFRINGEMENT
  • RELIABILITY

We do not guarantee:

  • Reduced alcohol consumption
  • Behavior change success
  • Specific outcomes

Your results depend on your actions.

13. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

WE SHALL NOT BE LIABLE FOR:

  • Indirect damages
  • Incidental damages
  • Consequential damages
  • Lost profits
  • Emotional distress
  • Personal injury

OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF:

  • $100 

OR

  • The amount paid by you in the three

(3) months preceding the claim.
Some jurisdictions do not allow certain limitations; in those cases, liability is limited to the maximum extent permitted by law.

14. INDEMNIFICATION

You agree to indemnify and hold harmless MYDRY 30 LLC and its affiliates, officers, employees, contractors, and agents from any claims arising from:

  • Your misuse of the Services
  • Your violation of these Terms
  • Your violation of law
  • Your User Content

15. DISPUTE RESOLUTION – BINDING ARBITRATION

PLEASE READ CAREFULLY.

Any dispute arising from these Terms or the Services will be resolved by binding individual arbitration.

You waive:

  • Jury trial rights
  • Class actions
  • Representative actions

Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

The Federal Arbitration Act governs this provision.

Either party may bring individual claims in small claims court.

Any claim must be filed within one (1) year of the event giving rise to the claim.

16. GOVERNING LAW

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

17. TERMINATION

We may suspend or terminate access at any time for violation of these Terms.

Upon termination:

  • Your license ends immediately
  • We may delete account access (subject to Privacy Policy obligations)

Provisions relating to liability, arbitration, intellectual property, and indemnification survive termination.

18. CHANGES TO TERMS

We may update these Terms at any time.

Changes become effective upon posting at https://um.app.

Continued use constitutes acceptance.
